Federal Appeals Court rejects liquor giant’s effort to throw out lawsuit over “angel’s share” fungus in Louisville.

The Louisville lawyer who successfully won a $24.8 million claim against the Roman Catholic Archdiocese of Louisville in 2003 over sex abuse has scored another victory in his three-year campaign against whiskey makers and a fungus that’s fed by ethanol vapors.

A three-judge panel of the Sixth Circuit Court of Appeals in Cincinnati has upheld a lower federal court’s ruling, allowing Louisville residents who have complained about tons of ethanol emissions from warehouses owned by Diageo Americas Supply to proceed with their lawsuit seeking relief.
